A right of light is an easement to enjoy the natural light that passes over someone else's land, and then enters through windows of a neighbouring building.
Open land does not necessarily enjoy rights to light. Once established, a right of light entitles the adjoining landowner to receive sufficient natural light. Such rights can prevent development upon your land if to do so would cause the rights of light of neighbouring landowners to be affected.
Those neighbouring landowners may have rights to seek an injunction preventing the build or damages for their loss.
We recommend that you inspect the Property and have a right to light surveyor issue a report as to the risks. This is particularly important if there are neighbouring properties close by.
