Planning permission for rooftop and airspace developments has changed in recent years.
In 2015 change of use from Class B1(a) (offices) to Class C3 (residential) was permitted by the Town and Country Planning (General Permitted Development) (England) Order 2015.
In 2020 new rights to permit rooftop and airspace development without full planning permission was permitted by the Town and Country Planning (Permitted Development and Miscellaneous Amendments) (England) (Coronavirus) Regulations 2020 and the Town and Country Planning (General Permitted Development) (England) (Amendment) (No. 2) Order 2020.
The latter permitted the construction of “up to two additional storeys, where the existing dwelling house consists of two or more storeys; or one additional storey, where the existing dwelling house consists of one storey, immediately above the topmost storey of a building” and “… any engineering operations reasonably necessary for the purpose of that construction”.
Any development is subject to various constraints and it is advisable to seek the advice of a planning consultant to help you acquire prior approval to your proposed development.
