The Grenfell Tower disaster caused the relevant authorities to review building regulations and fire safety, in particular in tall buildings where egress in the event of a fire may be difficult.
Cladding was found to be one factor and the Building (Amendment) Regulations 2018 (SI 2018/1230) were introduced in 2018.
Regulations for additional fire safety measures followed including a requirement for sprinklers for buildings above certain heights and fire escape requirements followed in 2020.
Before extending any building upwards careful consideration should be given as to whether the building as amended complies with building regulations including escape in the event of fire and what upgrades are required throughout the property. You will want to seek specific building regulations advice from an appropriate adviser.
If upgrades are required throughout the building you ought to ask your legal adviser what rights are available for you to enter on to the individual let units to make those upgrades. The risk in rooftop developments is that the existing tenants may frustrate the rooftop development by refusing access for those repairs. .
